1. INTRODUCTION
1.1 The general terms and conditions of sale outlined below (hereinafter referred to as the "Terms and Conditions"), exclusively govern the contractual relationship between any consumer customer of the Belair-paris.fr Website (hereinafter referred to as a "Customer" or "you"), and the company, Fashion Bel Air, a corporation with equity of €1.743.170,22, whose registered office fis 210, Rue Saint-Denis 75001 Paris, France, and which is registered with the Paris Trade and Companies Registry under registration number B 378 728 885 (hereinafter "Bel Air" or "we"), and operator of the Website: http://www.belair-paris.fr (hereinafter the "Website").
These are the only terms and conditions applicable between the Customer and Fashion Bel Air. They replace all other terms and conditions, except in the case of express prior written consent.
Fashion Bel Air may occasionally amend certain provisions in their Terms and Conditions. It is thereby necessary that these terms and conditions are read each time you place an order through the Website. These amendments take effect once posted online and cannot be applied to previous orders. Each order placed through the Website is governed by the Terms and Conditions applicable on the date of such an order. We maintain that by confirming your order after having read the terms and conditions, you unreservedly accept these terms and conditions. By accessing the Website, you agree to the Terms and Conditions and the terms of use for the Website, www.belairparis.fr, therein.
1.2 For any order placed with a third party merchant partner of Bel Air Paris on this site and identified as such, the terms and conditions of sale applicable to the said order will be those of the merchant partner, which are available on the latter's page of the Website. You must read and formally accept these terms and conditions in order to finalize your order with the merchant partner of Bel Air Paris. You must then also read and accept the Terms and Conditions of Use for the arrangement, which outlines the intermediary role that Fashion Bel Air plays between you and the merchant partner.

2. ORDERING
We offer you two ways to place your order:

In line with our commitment to fight against fraudulent payment on the Internet and thereby protect all consumers, your order may be subject to prior validation by our service. This validation triggers the request to prepare your order. You can monitor the status of your order from the "Your Account" section on the Website.
3. PRICE
The sale prices indicated on the Website are in Euro and include all taxes but do not include shipping fees. Shipping fees and delivery methods are indicated to the Customer during product selection. The cost of shipping is listed for the customer at checkout, in addition to the price of the selected products, and before the customer confirms acceptance of the total cost.
We reserve the right to change our prices at any time but we will honour the prices indicated on the Website at the time your order was placed.
We would like to inform you that if an obviously incorrect price appears on our Website (a price that is clearly too low), for whatever reason (computer glitch, manual error, technical error, etc.), the order – even if initially confirmed by us – will be cancelled, and you will be notified of this as soon as possible. You can re-order your item(s), if you wish, at the correct and accurate price.
4. AVAILABILITY
Fashion Bel Air will honour your order while stock is available.
In the event that a product is unavailable, we will offer you a refund, for the cost of that item within a maximum period of 15 days following the date of payment
5. PAYMENT
5.1 Payment Methods
Fashion Bel Air offers several payment methods:
1. Payment by credit card (CB, Visa or MasterCard): The card is debited once you confirm your order.
2. Payment by PayPal
5.2 Payment Security
In line with our commitment to secure payments, all online payments by bank or credit card are made via the Atos security system, which encrypts your banking information during the transmission.
We also wish to inform you that Fashion Bel Air verifies the accuracy of the information you provide when placing an order. This is part of our commitment to fight against fraudulent payment on the Internet and to thereby protect all consumers. In certain cases, our fraud prevention service may therefore ask you for additional information (such as: copy of ID, proof of address, etc.) to confirm your purchase and to ship your package.
In this case, to ensure your order is shipped on time, we recommend that you provide a phone number where you can be easily reached, and to confirm the information provided or send us the requested documents as soon as possible.
If you wish to avoid having to send us such information, we recommend that you pay with a payment method other than a bank or credit card.
6. DELIVERY
6.1 Delivery Locations
Products purchased on the Website are delivered to mainland France, Corsica, certain overseas departments (Guadeloupe, Martinique, French Guyana, Reunion), Monaco and Europe.
Fashion Bel Air does not deliver to PO boxes and military bases.
6.2 Delivery Period
When the item is displayed on the Website as in stock, the delivery date is determined by the sum of the following two factors:
1. Shipping period (24-48 hours): verification, once payment is made, that the information entered by the customer is accurate (refer to Article 5.2 "Payment Security") + preparing your order and package pick-up by the carrier
2. Delivery period (48-72 hours) for your package, based on the carrier chosen for delivery from the Website.
You will be notified of the delivery deadline for your order before confirming your order. This information will also be in the confirmation sent to you via e-mail. You will also find this delivery deadline under the "Your Account" section on the Website.
6.3 Delivery Methods
Fashion Bel Air only uses Colissimo for delivery. For further details, please refer to the Shipping Methods page.
6.4 Shipping Fees
Shipping fees are based on the delivery method chosen by the Customer and are calculated for the entire order. They will be indicated to the Customer upon checkout before the order is confirmed.
6.5 Delivery
Upon receipt of your order, we recommend that you check for damages and to ensure that the items delivered match your initial order and, if applicable and where possible, indicate any discrepancy in the order on the delivery slip in the discrepancy section along with your signature.
We recommend that you send us these discrepancies as soon as possible.
Fashion Bel Air strives to meet the delivery times indicated when you place your order. However, in the event that you have not received your package within the specified time period, the Customer is asked to report this to Fashion Bel Air so we can start an investigation. This may take several days.
In any event, if the delivery is 7 days overdue from the indicated deadline, and this is not due to force majeure, you may cancel your order by registered letter with acknowledgement of receipt. We undertake to refund the amount paid as soon as possible and no later than 30 days from your request.
7. RETURNS
7.1 General Terms
It is recommended that you include a completed and signed return form with any returned packages. This return form is available and can be completed in the "Your Account" section on the Website.
The package may be returned with the carrier of your choice. It is strongly recommended that the merchandise be returned via registered post, and that you purchase, if necessary, insurance with the carrier for the market value of the products to protect yourself against loss or damage.
7.2 Return with the right to withdrawal: "Money Back Guarantee" - all products
This article applies to all products.
Fashion Bel Air allows you 14 days provided in Article L. 121-20 of the Consumer Code to return the product if you are not satisfied, with no penalty, except the return postage. This period starts from the date your package is delivered.
This right of return will only be accepted for products returned in a condition where they can be resold by Fashion Bel Air (with their accessories, tag etc.). Items returned incomplete, damaged or soiled by the Customer will not be accepted.
When you exercise your right of refusal, Fashion Bel Air will refund your full order within a maximum period of 15 days:
- in cash if the right of refusal is exercised within 14 days following receipt of the ordered products
- as a credit on your "account" from the 8th to 15th day following receipt of the ordered products. Please note that no refunds will be given at a Fashion Bel Air store.
7.3 Return of a substandard product
If you find that the received product does not match the product ordered or the description on the Website, you may apply for a repair or replacement.
We will cover the cost of the return.
If a repair or replacement is not possible, the Customer may return the product and receive a refund for the corresponding amount.
8. PRODUCT WARRANTIES
All sold products benefit from:
- a legal warranty
- a legal warranty against hidden defects
Shipping fees for the item(s) are charged to the customer.
For any package return, you should either return it to us by Post or by another carrier.
Whatever the problem with your product, you must include a copy of the receipt, the supplied warranty slip (in the box) and the return slip along with the defective item.
9. DISPUTES AND LIABILITY
This contract is subject to French law.
Fashion Bel Air cannot be held liable for breach of contract in the event of force majeure, as defined by the courts, in case of fault by the Customer or the unpredictable and insurmountable act from a third party in the contract.
10. PROTECTION OF PERSONAL DATA
The information you provide us is essential for processing and delivering orders, and preparing invoices and warranty contracts, and the absence of this information will result in your order being cancelled. By registering on the Website, you agree to provide us with genuine and true information about yourself. The communication of false information is contrary to these Terms and Conditions and the terms of use on the Website. Thereby you authorize Fashion Bel Air to collect, process and use your personal information.
In accordance with Law No. 78-17 of January 6, 1978, "Data Protection, Data Files and Individual Liberties", the collection and processing of your personal data was the subject of a declaration with the Commission Nationale de l'Informatique et des Libertés (CNIL) [French Administrative Authority protecting privacy and personal data] under receipt number 1632752 v 0.
Fashion Bel Air is only storing your personal information.
At any time you can ask Fashion Bel Air what personal information Fashion Bel Air is storing about you. You can object to the processing of this information, or have this information altered or deleted by contacting customer service.
If, when you registered on the Website, you accepted that Fashion Bel Air and its business partners may send you information by e-mail as part of accurate and timely promotional campaigns. These partners have been specially chosen by Fashion Bel Air based on the quality of their products and services.
You can ask to stop receiving these e-mails at any time by clicking here or on the link provided for this purpose and inserted in the footer of every e-mail sent to you.
We wish to inform you that cookies record certain information that is stored in the memory of your hard drive.
